NOTICE

THE PEOPLE OF THE STATE OF FLORIDA, et al Vs. GOVERNOR OF THE STATE OF FLORIDA, A POLITICAL SUBDIVISION, et al. Case Number 23-008629-CI. Chancery Court, Pinellas County Sixth Judicial District.

Default Judgments were entered against Ken Burke, Charles W. Thomas, Bob Guiliatieri, Mike Twitty, Alexander Luca, Brian Aungst Sr., Kathleen Beckman, Mark Bunker, David Allbritton, and Lina Teixeira and confirmed by a unanimous jury. Gina Clayton has been dismissed from the action.

On October 11, 2023, Burke, Thomas, Guiliatieri, Twitty, Luca, Aungst, Beckman, Bunker, Allbritton, and Teixeira were each sued in their personal/private capacity. Each was given a twenty-day summons to respond.

Last call for their answer was on November 1, 2023; Burke, Thomas, Guiliatieri, Twitty, Luca, Aungst, Beckman, Bunker, Allbritton, and Teixeira failed to defend themselves against the allegations. Instead, they appear to have conspired with the Clearwater City Attorney’s Office, Pinellas County Attorney’s Office, and the Pinellas County Sheriff’s Office Counsel, to use City and County resources to shield themselves from personal liability, contrary to Fla. Stat. 768.28 (9). The petitioners contend that Burke, Thomas, Guiliatieri, Twitty, Luca, Aungst, Beckman, Bunker, Allbritton, and Teixeira, by doing so, had confessed judgment and breached their duty to defend their personal lawsuits in a timely manner.

The accusations against Burke, Thomas, Guiliatieri, Twitty, Luca, Aungst, Beckman, Bunker, Allbritton, and Teixeira extended to their failure to protect the obligations of contracts, specifically the provisions of the Statute of July 25, 1845. The petitioners alleged that each, Burke, Thomas, Guiliatieri, Twitty, Luca, Aungst, Beckman, Bunker, Allbritton, and Teixeira, had breached their duties of care, giving aid-and-comfort for the implementation of communist principles to be enacted, disguised, and camouflaged within Florida Laws, Statutes, Codes, Rules, Regulations, and Ordinances. The petitioners contended that their actions, and lack thereof, amounted to a confession of “maliciously and wantonly” breaching each of their oaths of offices and loyalty oaths.

On November 7, 2023, a jury of the People of Florida assembled. After hearing the evidence and weighing the facts, the unanimous jury of the People delivered its verdict, finding Burke, Thomas, Guiliatieri, Twitty, Luca, Aungst, Beckman, Bunker, Allbritton, and Teixeira guilty, in absentia, of violating fundamental laws, giving aid-and-comfort for the implementation of the Planks of Communist Manifesto which are disguised and camouflaged within the fabric of Florida Laws, Statutes, Codes, Rules, Regulations, and Ordinances.

On November 13, 2023, DEFAULT JUDGEMENTS were entered against Burke, Thomas, Guiliatieri, Twitty, Luca, Aungst, Beckman, Bunker, Allbritton, and Teixeira. The jury also found Florida Tax Laws (Fla. Stat. 192.011) to be unconstitutional as currently administrated and applied, because it implicates the First and Fourth Planks of the Communist Manifesto which are contrary to Federal and States Laws and Our Founding Fathers wishes for a more perfect union and was thereby nullified-having no force and effect from the date of this judgment, because the Statute itself failed to consider that Florida never reserved any right for taxation or regulation upon public lands disposed of by the United States in Florida.
